Shariah Status of Transgender Act
What is Transgender Act?
The Rotation of Rights Act 2018 is commonly known as the Transgender Rights Act. This law was passed in the last months of the PML-N regime when Shahid Khaqan Abbasi was the prime minister. It was one of the few laws in favor of which the government and the opposition unanimously voted. Although a few friends raised their voices against it, no one recognized them. When this law was challenged in court, the facts which were kept secret became clear there. After all, what is the reason why Islamist circles are worried about this bill? There is something that is covered.
This bill has been cleverly propagated that these laws are being made for the rights of transgenders, when in fact, this is the case.
That the rights of citizens belonging to the third gender have been robbed, and an attempt is being made to include such people in their community who are not actually a part of them.
If we look at this bill, very dangerous legislation has been made through Clause No. 3 of this Bill and its sub-clause No. 2, in which it is said:
“The sex of any person shall be determined according to his own will.”
This would mean that a man stands up and declares that I have developed female sensibilities, so if I am considered a woman from now on, not only will his claim be accepted, but according to that, he will be given documents, i.e., Identity card and passport, etc. will also be issued. Similarly, if a woman claims that she does not like being a woman, then she will be considered a man according to her claim, and she will be issued identity documents according to the gender of men. In this process, neither the medical board ban nor the condition of his psychological examination was set.
In the last three years, from July 2018 to June 2021, 28,723 people have applied to identify themselves as separate from the gender they were assigned at birth based on their physical and internally felt feelings and emotions. It was done, and now they have changed their gender.
Most of them are men. That is, 16530 men registered themselves as women. This was followed by 12,154 women identified as female at birth but now legally identified as male. There were only nine men who said that we were actually eunuchs. We have mistakenly put in the men’s account.
On the contrary, 21 eunuchs are those who say that we are full men and now we should be called men, while nine eunuchs requested to be called women.
Some aspects of the Transgender Act
There are a few reasons why the Transgender Law is an anti-Islamic law:
Disagreement on divine distribution
The first defect in this is that such people are not satisfied with Allah’s creation and division because they think that the way Allah Subhanahoo Wata’ala made us is not better for us.
It is as if such people try to adopt the opposite sex because they are not satisfied with the decision made by Allah Subhanahoo Wata’ala about them, while Allah Subhanahoo Wata’ala said about a man:
ٱلَّذِى خَلَقَكَ فَسَوَّىٰكَ فَعَدَلَكَ (٧) فِىٓ أَىِّ صُورَةٍۢ مَّا شَآءَ رَكَّبَكَ (٨)
Translation,
Who created you, then perfected you, then brought you in due proportion? (82:7) He composed you in whichever form He willed. (82:8)
Allah Subhanahoo Wata’ala made man male or female according to His will, but trying to change gender according to his/her will against the will of Allah Subhanahoo Wata’ala because he/she does not like the division of Allah Subhanahoo Wata’ala.
Resembling the opposite sex
This law is also not permissible because it tries to make men look like women and women look like men, while this is forbidden in Shariat. There are some arguments for this.
وَعَنْ اِبْنِ عَبَّاسٍ رَضِيَ اَللَّهُ عَنْهُمَا قَالَ: لَعَنَ رَسُولُ اَللَّهِ - صلى الله عليه وسلم -اَلْمُخَنَّثِينَ مِنْ اَلرِّجَالِ, وَالْمُتَرَجِّلَاتِ مِنْ اَلنِّسَاءِ, وَقَالَ: { أَخْرِجُوهُمْ مِنْ بُيُوتِكُمْ }
حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ مُعَاذٍ، حَدَّثَنَا أَبِي، حَدَّثَنَا شُعْبَةُ، عَنْ قَتَادَةَ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم أَنَّهُ لَعَنَ الْمُتَشَبِّهَاتِ مِنَ النِّسَاءِ بِالرِّجَالِ وَالْمُتَشَبِّهِينَ مِنَ الرِّجَالِ بِالنِّسَاءِ
It is mentioned in these two blessed hadiths that the Prophet (ﷺ) cursed those men who become like women and adapt their behavior and cursed those women who artificially become men and adapt their behavior. Do it, and he said, drive them out of their homes.
وَعَنْ أَبِي هُرَيْرَةَ قَالَ: لَعَنَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الرَّجُلَ يَلْبَسُ لِبْسَةَ الْمَرْأَةِ وَالْمَرْأَةَ تَلْبَسُ لِبْسَةَ الرَّجُلِ
He cursed the man who dressed like a woman and the woman who dressed like men.
عن عبد الله بن عمر رضي الله عنه قال قال رسول الله صلى الله عليه وسلم – ثلاثة لا يدخلون الجنة : العاق بوالديه والديوث ورجلة النساء

It also includes men and women who cannot enter Paradise.
Transformation into divine creation
In order to change your sex, it is necessary to change the creation of Allah Subhanahoo Wata’ala. Allah Subhanahoo Wata’ala said:
لَّعَنَهُ ٱللَّهُ ۘ وَقَالَ لَأَتَّخِذَنَّ مِنْ عِبَادِكَ نَصِيبًۭا مَّفْرُوضًۭا (١١٨) وَلَأُضِلَّنَّهُمْ وَلَأُمَنِّيَنَّهُمْ وَلَـَٔامُرَنَّهُمْ فَلَيُبَتِّكُنَّ ءَاذَانَ ٱلْأَنْعَـٰمِ وَلَـَٔامُرَنَّهُمْ فَلَيُغَيِّرُنَّ خَلْقَ ٱللَّهِ ۚ وَمَن يَتَّخِذِ ٱلشَّيْطَـٰنَ وَلِيًّۭا مِّن دُونِ ٱللَّهِ فَقَدْ خَسِرَ خُسْرَانًۭا مُّبِينًۭا (١١٩)
Translation,
Whom Allah has cursed. He (the Satan) said, “Surely I will take an appointed share from Your slaves, (4:118) and I will lead them astray, and I will tempt them with false hopes, and I will command them, whereby they shall slit the ears of cattle, and I will command them, whereby they shall alter the creation of Allah.” Whoever takes the Satan for friend, instead of Allah, incurs an obvious loss. (4:119)
Allah Subhanahoo Wata’ala said:
لَا تَبْدِيلَ لِخَلْقِ ٱللَّهِ ۚ
Means that,
There is no change in Allah’s creation. (30:30)
In fact, those who try to change the creation of Allah Subhanahoo Wata’ala, it is the favorite act of Satan.
Homosexuality
One of the drawbacks of the Transgender Act is that if any man marries a man by converting himself into a woman, he will be committing the sin of adultery.
And this is an act that causes severe punishment from Allah Subhanahoo Wata’ala.
وَعَنِ ابْنِ عَبَّاسٍ وَأَبِي هُرَيْرَةَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: مَلْعُونٌ مَنْ عَمِلَ عَمَلَ قَوْمِ لُوطٍ
Due to this sin, the people of Lut were subjected to the most severe wrath; Allah Subhanahoo Wata’ala killed them with a shower of stones.
Social Distortion of Transgender Act
- A man can go to the NADRA office and get himself registered as a woman and get married to a man.
- A man can go to places reserved for women, such as toilets, swimming pools, etc., after registering a woman.
- Due to gender change, the difference between males and females will disappear.
- Because of such people, problems will arise for women who wear the Islamic veil.
The Transgender Act and what we can do
- First, try to understand this Act and its seriousness.
- Share authentic content with people in this regard.
- Writers, by their writings, khatibs, by their speeches, and influential people by their connections, raised their voices against it.
- A message should be sent to the Senate Standing Committee on Human Rights to repeal this Act.
- Dua should be made in the words of Allah Ta’ala with Al-Hah.
